Extend the IRS’s ability to audit ERC claims through 2030 - far beyond what is required by current law. This affects a business’s ability to secure financing or be sold, as ERC will be viewed as unresolved liability or risk. Even with a valid claim, an audit in 2030 for events related to 2020-21 can be time consuming and expensive, especially if there are personnel changes.
Invalidate all ERC claims made after January 31, 2024 - this is not only devastating to a business who is anticipating these funds, but it sets a dangerous precedent for ALL taxpayers - that Congress can retroactively re-write deadlines after they pass.
If you have a Republican U.S. Senator, it is vital you or someone on your staff call their office right away and ask them to call Senator Crapo (R-ID), who is the Chairman of the Senate Finance Committee responsible for writing the tax provisions in the One Big Beautiful Bill. Simply state who you are, express your concern about the retroactive ERC changes, and request a response from your Senator.
If you have a Democrat U.S. Senator, do the same thing, but ask them to call Senator Schumer (D-NY), who is the Senate Minority Leader, to insist that the Democrat Party protest ERC repeal. Similarly, request a response to hold them accountable. Please call both of your U.S. Senators.
